FOOD VENDOR TERMS OF AGREEMENT
1. All Food Vendors and Exhibitors ("Exhibitors")
must pay to Freehold Center Partnership ("Sponsor")
a fee of $425.00 for a 16'x16' space or $275.00
for a 10'x10' space, which is non-refundable,
except in the event of inclement weather requiring
cancellation of the Festival for which no rain
date can be scheduled. Refunds will not be paid
if the Exhibitor is not available on the rain
date. Should full Festival cancellation occur,
a refund, less a 20% administration fee, will
be issued by Sponsor.
2. Sponsor will provide the space and all signage,
as it deems appropriate. Sponsor will also supply
two 8 -foot tables.
3. Exhibitor is responsible for all cooking
equipment/utensils, linens, skirting and chairs
for Exhibitor's staff, if it deems necessary.
Cooking equipment must be limited to propane
and/or sterno. No electricity will be available.
4. Exhibitors must supply napkins, paper/plastic
plate s , and any necessary serving and eating
utensils. No glass bottles or containers may
be provided to the public and all eating utensils
must be disposable.
5. At least ten (10) days prior to the event,
Exhibitor must provide to Sponsor a certificate
of Insurance evidencing adequate proof of general
liability (bodily injury/property damage) insurance
(covering usual restaurant exposures, including
food and beverage products) in the minimum amount
of $1,000,000 per person/$3,000,000 per occurrence
as well as a valid food handlers permit and
inspection certificate from the local issuing
authority. Insurance coverage must include a
special events endorsement specifying Sponsor,
Freehold Center Partnership, Inc., CentraState
Healthcare and the Borough of Freehold as additional
insured.
6. Exhibitor must have a menu and fair pricing
approved by the Sponsor not less than (30) days
prior to the date of the Festival. Failure to
obtain such approval within (30) days may result,
at a minimum, in no guarantee of signage for
the Exhibitor. Only those items reviewed and
approved by the Sponsor will be permitted for
sale. The Sponsor, in its sole discretion, reserves
the right to refuse unacceptable items or duplicative
items that will be sold by other Exhibitors.
7. Exhibitor agrees to keep its booth completely
assembled and staffed for the duration of the
event.
8. Exhibitor must completely set up at least
one-half (1/2) hour before the start of the
event.
9. After the completion of the event, Exhibitor
must clean the space provided as close as possible
to the condition it was in prior to start. Cleaning
must be completed within two (2) hours to permit
Festival staff to complete "knockdown"
of tables within three (3) hours.
10. The undersigned Exhibitor agrees to release
and hold Sponsors harmless from any loss, damage
or liability incurred by it related to the Festival,
except as to any intentional or negligent acts
of Sponsor's officers or employees.
